Brazil Introduces Fast-Track Trademark Examination (Effective August 7, 2025)

Brazil Launches Fast-Track Trademark Examination – Effective August 7, 2025

The Brazilian Patent and Trademark Office (BPTO) has formally announced the implementation of a Fast-Track Trademark Examination procedure, marking a major advancement in Brazil’s trademark system. This initiative is part of the BPTO 2025 Strategic Action Plan, focused on accelerating innovation, improving IP enforcement, and streamlining brand protection mechanisms.

Insight:
This measure enhances predictability, speeds up rights acquisition, and enables strategic timing for foreign applicants launching brands or entering licensing deals in Brazil.

Who Can Apply?

The following categories are eligible for fast-track examination:

  • Applicants aged 60 or older
  • Individuals with disabilities or serious illness
  • Startups under the Inova Simples regime
  • Trademark applications facing formal opposition
  • Cases tied to judicial actions or requiring public funding
  • Trademarks linked to patents already under accelerated review
  • Applicants connected to ICTs or BPTO Cooperation Agreements
  • Matters of national emergency or public interest

Why It Matters

Until now, Brazil offered no formal pathway for trademark fast-tracking. The new regulation provides a legitimate, clear, and structured mechanism for obtaining priority status—ensuring faster resolution in critical commercial scenarios.

What It Means for You

This reform aligns Brazil with international IP best practices and unlocks new strategic tools for foreign applicants and legal representatives navigating the Brazilian market.
