The Brazilian Patent and Trademark Office (INPI) has taken a significant step toward modernizing its trademark system by publishing an updated version of Section I – Communications of the Industrial Property Gazette (RPI) No. 2847. The republication, made on July 29, 2025, formally includes Portarias INPI/PR nº 27, 28, and 29, which launch the pilot phase of Brazil’s new Fast-Track Trademark Examination Program.
The reform, set to begin on August 7, 2025, and run through December 7, 2025, aims to inject agility, transparency, and strategic value into the trademark examination process. This initiative marks a new era for applicants seeking legal certainty and commercial speed in one of Latin America’s largest IP markets.
The newly published Portarias establish formal criteria and procedures for accelerated examination of trademark applications under select priority categories. This is the first structured implementation of fast-track review in Brazil’s trademark regime.
Eligible applicants include:
Trademark filings under formal opposition;
Applications tied to judicial actions or requiring public funding;
Cases associated with patents undergoing expedited review;
Applicants affiliated with Science, Technology, and Innovation Institutions (ICTs) or operating under a BPTO Cooperation Agreement;
Matters involving public interest or national emergency;
In addition to previously recognized priorities (such as age, illness, or status as an Inova Simples startup).
MJZanon Insight: This pilot phase will serve as a testing ground for integrating speed into Brazil’s notoriously slow trademark workflows, with the potential to significantly reduce pendency times and attract more foreign investment.
Also included in the republication is Portaria INPI/PR nº 25, which amends the 2022 guidelines on the recognition of well-known (alto renome) trademarks in Brazil.
Key updates include:
Nationally scoped market and image research are now recommended as key evidence;
The INPI is authorized to issue specific demands for additional evidence or clarification during the evaluation process;
The changes apply only to new requests submitted after August 7, 2025, with no retroactive effect.
This update offers greater procedural transparency for rights holders seeking to elevate the scope of protection for their brands beyond their registered class.
In parallel, Consulta Pública INPI/PR nº 02/2025 invites stakeholders to comment on Chapter 9 of the Patent Examination Guidelines in the Field of Chemistry, specifically addressing new uses of known substances. The consultation remains open for 60 days from the publication date.
