Brazil Accelerates Trademark Reform: RPI 2847 Introduces Fast-Track Procedures and New Legal Frameworks

Brazil Accelerates Trademark Reform – Fast-Track Pilot Begins August 2025

The Brazilian Patent and Trademark Office (INPI) has officially republished Section I – Communications of RPI No. 2847 to include Portarias INPI/PR nº 27, 28, and 29, launching Brazil’s first formal Fast-Track Trademark Examination Pilot Program.

Pilot Phase: August 7 to December 7, 2025
⚙️ Objective: Speed up examinations, improve predictability, and modernize Brazil’s trademark system.

Who Qualifies for Fast-Track?

  • Trademark applications facing formal opposition
  • Cases involving judicial actions or public funding
  • Applications linked to patents under accelerated review
  • ICTs or entities in BPTO Cooperation Agreements
  • Matters of national emergency or public interest
  • Legal priority groups (age 60+, illness, Inova Simples startups)

️ Updated Rules for “Alto Renome” (Well-Known Trademarks)

Portaria INPI/PR nº 25 (also included in RPI 2847) revises how high renown is proven:

  • Requires national market and image research
  • INPI may request additional or updated evidence
  • Applies only to requests filed after August 7, 2025

Patent Sector – Public Consultation Open

INPI has opened Consulta Pública INPI/PR nº 02/2025 on patent examination guidelines for new uses of known substances in chemistry.
