In compliance with the preliminary decision of ADI 5529, issued on April 7, 2021, by Minister Dias Toffoli, the provision provided for in the sole paragraph of art. 40 of Law 9,279 to patents granted as of that date, related to pharmaceutical products and processes and to equipment and / or materials for use in health.
In order to provide greater legal certainty, we are partially automating the patent selection process for the application of the preliminary decision. The methodology below will be executed from the Gazette 2624. However, we clarify that changes may be introduced as we identify the need for inclusion / exclusion of classifications, back to the date of application of the injunction.
The selection was applied in three groups:
First group: patent applications sent to ANVISA – those that have been dispatched 7.5 (prior consent) will be automatically included; those who underwent dispatch 7.7 (not included in 229-C) will undergo manual review.
Second group: patent applications included in the field of medical technologies, according to classifications listed by WIPO (classifications A61B, A61C, A61F, A61G, A61H, A61J, A61L, A61M, A61N, H05G, in any position) will be automatically included.
Third group: patent applications that present classifications relevant to human health, listed by the INPI (A61k 6/00 – preparations for dentistry; C12Q – diagnosis involving enzymes; G01N 33 – relating to diagnosis) will undergo manual review.
