Starting August 7, 2025, the Brazilian Patent and Trademark Office (INPI) will offer a new service: the Trademark Fast-Track Procedure. This initiative allows certain trademark registration requests and petitions to be reviewed more quickly, based on legal criteria or strategic goals and public policies defined by the Institute. This action is part of the INPI Action Plan 2025, aimed at strengthening Brazil’s innovation ecosystem and fostering economic growth.
Who can apply?
The request can be made by the applicant or a legal representative. In all cases, a specific form must be filled out, the applicable fee (if any) paid, and supporting documents proving the right to priority submitted. In cases of joint ownership, all co-applicants must meet the required conditions. There are two ways to request the fast-track:
Cases with priorities defined by law
Free of charge and no quota limit (GRU Code: 3019)
Eligible applicants:
Individuals aged 60 or older
Individuals with serious illness
Individuals with disabilities
Companies under the “Inova Simples” model
Cases related to strategic objectives and public policies
Subject to quota limits and a fee of R$ 890.00 (GRU Code: 3020)
Eligible applicants:
Those who filed opposition based on prior rights
Those requiring registration to release public funding
Parties involved in legal action
Applicants with a product or service related to a patent in fast-track review
Scientific, Technological, and Innovation Institutions (ICTs)
INPI mentees under a Technical Cooperation Agreement (ACT)
Public interest or national emergency cases
The Trademark Fast-Track Procedure aims to make the system more efficient, serving those in most urgent need. Be attentive to deadlines and required documents.
